FEES AND CHARGES FOR HOUSING MANDATORY LICENCE RENEWALS
Matter for Consideration:
To consider fees and charges to Housing Mandatory Licence Renewals for 2013/2014.
Information:
The attached sheet outlines proposed amendments to the fees and charges for Mandatory Licence renewals. The Mandatory Licence Scheme came into force in April 2006. Mandatory Licensing Schemes apply to Houses in Multiple Occupation (HMOs), three stories or more and five or more people sharing facilities under Part 2 of the Housing Act 2004.

The Licensing and Management of Houses in Multiple Occupation and other Houses (Miscellaneous Provisions) (Amendment) (England) Regulations 2012 apply to renewal Mandatory Licensing Schemes from September 2013. The regulations state that renewals should be charged less than original fees as the process is mainly by self declaration. A renewal applicant is required to declare that the information in question has not materially changed since the existing licence was granted or to set out any material changes as part of the declaration. The Council currently charges £904 for the original mandatory fee and the proposal is for renewals to be £695.

Legal Considerations:
The Council is adjusting its charges to reflect officers' time and work involved during the Mandatory Licence operational period and other neighbouring Local Authorities mandatory charges in their area.

None, the proposals are in line with the equalities impact assessment for the general fund revenue budget 2013/2014.
Financial Considerations:
The attached proposed renewal fee sheet will enable services to meet their cash limited budget targets in 2013/2014.
